Products Liability - Farm Implement

Plaintiff was using a John Deere cotton stripper on his farm in Lubbock, Texas, when one of the welds that supported the hydraulic lift to the basket broke. As he worked to free the basket and undertake repairs, the basket collapsed and suffocated him. After a lengthy jury trial in Dallas, Texas, the jury awarded a sum to the Plaintiff's surviving family.

Industrial Accident

Plaintiff was working as a welder's helper at the Formosa Plastics plant in Point Comfort, Texas, when a sight glass blew up inches away from his face. The explosion claimed plaintiff's left eye, and left him disfigured and partially blinded for life. A financial settlement was made during mediation.

Publisher's Liability

This is a wrongful death action brought against a magazine publisher for advertising "personal service" ads that offered to commit murder. The client was the surviving son of one of the murder victims. The "hit man" testified that he had been hired as a result of the advertisement he had placed in the magazine. The jury awarded the client damages.

Products Liability - Air Bag Defect

Plaintiff was wearing her seat belt at the time of a low-speed one-car accident when the airbag deployed and killed her. She was driving a Ford Taurus. The autopsy report revealed injuries completely inconsistent with any normally sustained automobile accidents, but matched all too common injuries seen in cases of aggressive airbag deployment. Her skull was forced off of her spine at the time of the accident. This case was settled for a confidential amount.

Workplace Accident

Plaintiff fell from an unsafe ladder during a renovation project, sustaining permanent, severe brain damage. After a two-week trial, the jury awarded the Plaintiff a substantial amount. The Plaintiff had previously rejected a lower settlement offer.

Motor Home Explosion

This case arises from an explosion of a motor home in Pecos, New Mexico. The Plaintiffs, a retired couple, bought a Holiday Rambler motor home that incorporated an 80-gallon propane tank designed to be used as fuel for cooking and as an alternate fuel source. The tank was overfilled by a Farmington filling station that caused pressure in the tank to increase and ultimately release propane. After a spark ignited the propane, Plaintiff became trapped in the burning vehicle and died. Her husband was severely burned while trying to rescue her. The case was settled in mediation for a confidential amount.

Longshoreman Accident

This case arises from an accident that occurred on the Port of Houston docks. The Plaintiff, a 34-year old longshoreman, stopped to assist another longshoreman in getting his forklift free from the mud. In the process a "D-ring" fractured and hit him in the head, causing a severe open head injury and brain damage. The case was settled for a confidential amount.

Products Liability - Air Bag Defect

In the summer of 1995, two 16 year-old girls were driving a Toyota Camry in Garner State Park when they hit a tree at a slow speed. The Plaintiff, the passenger, reflexively put both hands and arms up to protect herself during the collision. At impact, the blast from the air bag threw her against the door, and her left arm was thrown up and over the back of the seat. She lost complete use of the arm. A financial settlement was made.

Products Liability - Air Bag Defect

The Plaintiff, a front seat passenger, and her family were returning home in their Ford. All passengers had their seat belts properly buckled when the car hit a curb alongside the freeway. Although there was no front-end collision, when the vehicle's undercarriage hit the curb, the airbag deployed and struck the plaintiff with full force in the face and head. Unknown at the time of the incident, she suffered a tear in a primary artery that later created a clot. When the clot broke loose several months later, she suffered a stroke, which left her permanently paralyzed. During mediation a financial settlement was made.

Premises Liability and Negligence

The Plaintiff was working as a contract laborer who unloaded trucks on the docks of Alliant Food services for various food distributors. As he was backing the forklift out of the truck, the truck rolled away from the loading dock, and plaintiff and the forklift fell between the truck and the edge of the dock. The driver had not properly secured the truck. Plaintiff's left calf was torn from his leg. He underwent numerous orthopedic and vascular surgeries. A financial settlement was made.

Automobile Accident - Wrongful Death and Injury

The Plaintiffs were on their way to their west Texas home in the evening when they came upon a homemade trailer made from oil-field pipe, which had been abandoned on the roadway by the Defendant. The husband/father was unable to stop the family's pick-up truck in time, and a pipe from the trailer went through the windshield killing him and one of his 13 year old twin daughters who was sitting directly behind him. A Dallas jury awarded damages to the surviving wife, son and other twin daughter.

Products Liability

This case arises from a false reading on a Rochester gauge. The Plaintiff pulled his bobtail truck up next to a 150-gallon tank to have his tank filled with propane. The gauge read 40% full - which meant it could take another 60 gallons or so to fill. Plaintiff began the process. He hooked up the hose, turned some valves, and then got back in the cab of his truck to engage the pump. Before he could open the spitter-valve, the pop-off valve blew and within seconds the Plaintiff was on fire. The Plaintiff suffered burns over 38% of his body. A financial settlement was awarded to the Plaintiff.
